Once we have submitted a final report, our project is completed. After this, our recommendations are discussed by Government before they are put before Parliament.

Matrimonial property, needs and agreements

Making provision in law for binding nuptial agreements and helping people understand the law on meeting an ex-spouse’s financial needs on the breakdown of a marriage. Guidance has been produced, and scoping work undertaken by the government but we await a final response.

Insanity and automatism

We published a discussion paper on 23 July 2013 with our provisional proposals for reform of the defences of insanity and automatism, based on lack of capacity.

Contempt of court: scandalising the court

We produced our final report on Scandalising the Court on 19 December 2012, recommending the abolition of the offence. Our recommendation was implemented in the Crime and Courts Act 2013
